Divorce & Uncontested Divorce
Divorce! It is not good that a marriage between a man and a woman dissolves, but be assured: it's normal to feel upset or emotional by the prospect of a divorce.
In Florida, either spouse can basically get a divorce by declaring that their marriage is "irretrievably broken." You do not have to prove much except that one of the spouses must have resided for a minimum of 6 months in the County before the filing of legal documents.
Uncontested divorces are faster, much more economical, and they tend to reduce the emotional chaos associated with ending a marriage. Whether a dissolution of marriage is contested or uncontested depends on the parties, themselves. If the husband and wife can agree to each and every issue concerning their dissolution of marriage, then they can proceed uncontested. If the parties cannot agree to each and every issue, they must proceed with a contested dissolution of marriage.
The fewer issues the lawyer to fight in court, the less money their services will cost you. Both parties need to understand this. Requirements for the Uncontested Divorce of $699, plus the cost of court filing fees:
- Neither spouse has to be a U.S. Citizen or U.S. Legal Permanent Resident. You must have a valid identification (passport, state-issued ID, etc.) and satisfy the next requirement, in II below.
- One of the the spouses must have lived in Broward or Miami-Dade at least six (6) months prior to filing the papers with the Clerk of the Court.
- There can be no children of the marriage. If there are children, and the non-custodial spouse does not object to paying support or other agreements, there will be a nominal charge for filling out the required forms with the financial information.
- No property owned between the spouses (example: house, land, stocks or the family dog). If there is property and the Spouses agree to to a property settlement then there will be a small charge for filling out the extra forms. Litigation in a dispute for property is charged by the Firm's hourly rate.
- Must have a valid identification (driver's license, passport, State issued ID).
- Must have proof you lived in Florida for more than six (6) months prior to our firm filing the legal documents with the Clerk of the Court. Normally the issued date on your Florida driver's license cures that question.
- Provide the Attorney with a certified copy of your marriage certificate. If you were married outside the USA and the marriage certificate is in another language it is the responsibility of the client to have the certificate translated. Our firm translates documents from Spanish to English for a reasonable charge.
